This article briefly examines the topic of surrogacy in light of two opposing perspectives, mainstream feminism and Catholicism, which despite very different moral dimensions, arrive at the same conclusion. The author discusses the similarities between these two moral perspectives that are nor­mally considered to be opposed to each other.

This study focuses on retraction notices from two major Latin American/caribbean indexing databases: SciELO and LILACS. SciELO includes open scientific journals published mostly in Latin America/the Caribbean, from which 10 % are also indexed by Thomson Reuters Web of Knowledge Journal of Citation Reports. LILACS has a similar geographical coverage and includes dissertations and conference/symposia proceedings, but it is limited to publications in the health sciences. A search for retraction notices was performed in these two databases using the keywords “retracted”, (...) “retraction” “withdrawal”, “withdrawn”, “removed” and “redress”. Documents were manually checked to identify those that actually referred to retractions, which were then analyzed and categorized according to the reasons alleged in the notices. Dates of publication/retraction and time to retraction were also recorded. Searching procedures were performed between June and December 2014. Thirty-one retraction notices were identified, fifteen of which were in JCR-indexed journals. “Plagiarism” was alleged in six retractions of this group. Among the non-JCR journals, retraction reasons were alleged in fourteen cases, twelve of which were attributed to “plagiarism”. The proportion of retracted articles for the SciELO database was approximately 0.005 %. The reasons alleged in retraction notices may be used as signposts to inform discussions in Latin America on plagiarism and research integrity. At the international level, these results suggest that the correction of the literature is becoming global and is not limited to mainstream international publications. (shrink)

This volume suggests a novel treatment of context in the analysis of everyday interaction. On a theoretical level, it advocates a switch of focus from 'context' as a preestablished, monolithic category which constringes co-participants' verbal and nonverbal behaviour, to an active notion of 'contextualization': in order to make oneself understood, participants have to establish and maintain those shared contextual frames which in turn are relevant to the local interpretation of their verbal and nonverbal activities. On an empirical level, the volume (...) contains exemplary analyses that show how participants employ 'contextualization cues' of prosodic (rhythm, intonation, tempo, etc.) or nonverbal (gaze, gesture, etc.) nature in order to 'achieve context'.The volume is also an appraisal of the theory of contextualization developed by John Gumperz. In their contributions, researchers from various schools of research, such as conversation analysis, micro-ethnography, phonetics/phonology and metapragmatics, relate their work to this theory. The concept of soft facts is crucial for the Ockhamistic analysis of the divine knowledge of future contingents; moreover, this notion is important in itself because it concerns the structure of the facts that depend—in some sense—on other future facts. However, the debate on soft facts is often flawed by the unaware use of two different notions of soft facts. The facts of the first kind are supervenient on temporal facts: By bringing about a temporal fact, the agent can bring (...) about these facts. However, on the one hand, the determination of the existence of these facts does not affect the past; on the other hand, assimilating divine knowledge into this kind of facts does not help the Ockhamist. The authors will argue that, to vindicate Ockhamism, another definition of “soft fact” is necessary, which turns out to be much more demanding from a metaphysical point of view. (shrink)

In §21 of Grundgesetze der Arithmetik asks us to consider the forms: a a2 = 4 and a a > 0 and notices that they can be obtained from a φ(a) by replacing the function-name placeholder φ(ξ) by names for the functions ξ2 = 4 and ξ > 0 (and the placeholder cannot be replaced by names of objects or of functions of 2 arguments).

Many different modes of definition have been proposed over time, but none of them allows for circular definitions, since, according to the prevalent view, the term defined would then be lacking a precise signification. I argue that although circular definitions may at times fail uniquely to pick out a concept or an object, sense still can be made of them by using a rule of revision in the style adopted by Anil Gupta and Nuel Belnap in the theory of truth.

In this article, ambiguity attitude is measured through the maximum price a decision maker is willing to pay to know the probability of an event. Two problems are examined in which the decision maker faces an act: in one case, buying information implies playing a lottery, while, in the other case, buying information gives also the option to avoid playing the lottery. In both decision settings, relying on the Choquet expected utility model, we study how the decision maker’s risk and (...) ambiguity attitudes affect the reservation price for ambiguity resolution. These effects are analyzed for different levels of ambiguity of the act. Operating instructions for the elicitation of the reservation price for ambiguity resolution in an experimental setting are provided at the end of the article. (shrink)

According to the French philosopher Alain, art must regain its existence as a real and solid object to counteract deceitful imagination. In line with this view is Yves Michaud’s description of the “gaseous” state of contemporary art. Paradoxically, the wide circulation of many ‘artistic’ products, destined to be consumed and invoke emotions, does not indicate that we are in presence of an important affirmation of ethical and aesthetical values. As it were, the proliferation of aesthetic objects has destroyed the symbolic (...) value of art. The Italian philosopher Gianni Carchia has underlined how the disappearance of the axiological dimension has led art towards imposture and under the yoke of imagination, which both assist the strategies of the demonic. At this point a question arises: is it possible to eradicate the power of the demonic and evil from our existential condition? According to Jung it’s impossible. In Castelli’s view, the union between art, evil and the demonic has characterized the artistic panorama of the sixteenth century. In the twentieth-century, we owe to Hermann Broch – who brought the raising power of kitsch under philosophical scrutiny − the idea of a complicity between degraded art and evil. Not all scholars agreed that Kitsch represented evil. Many philosophers argued that the growing popularity of Kitsch among the masses posed a problem concerning the demand for art. For this reason, philosophical speculation had better not take a Manichean attitude and reject Kitsch outright, on the contrary, Kitsch should be studied with the aim of transforming the “hunger for art”, of which it is a manifestation, into a desire for ethical and artistic values. Consciousness is arguably the most important area within contemporary philosophy of mind and perhaps the most puzzling aspect of the world. Despite an explosion of research from philosophers, psychologists, and scientists, attempts to explain consciousness in neurophysiological, or even cognitive, terms are often met with great resistance. In The Consciousness Paradox, Rocco Gennaro aims to solve an underlying paradox, namely, how it is possible to hold a number of seemingly inconsistent views, including higher-order thought (HOT) theory, conceptualism, infant and (...) animal consciousness, concept acquisition, and what he calls the HOT-brain thesis. He defends and further develops a metapsychological reductive representational theory of consciousness and applies it to several importantly related problems. Gennaro proposes a version of the HOT theory of consciousness that he calls the "wide intrinsicality view" and shows why it is superior to various alternatives, such as self-representationalism and first-order representationalism. HOT theory says that what makes a mental state conscious is that a suitable higher-order thought is directed at that mental state. -/- Thus Gennaro argues for an overall philosophical theory of consciousness while applying it to other significant issues not usually addressed in the philosophical literature on consciousness. Most cognitive science and empirical works on such topics as concepts and animal consciousness do not address central philosophical theories of consciousness. Gennaro’s integration of empirical and philosophical concerns will make his argument of interest to both philosophers and nonphilosophers. (shrink)

In this paper, close attention is paid to the argumentative patterns resulting from combining pragmatic argumentation in which a recommendation is made with arguments in which the majority is invoked. I focus on such argumentative patterns as employed by European parliamentary committees of inquiry conducting inquiries into the activity of the Equitable Life Assurance Society. By incorporating legal and political insights about the activity of these parliamentary committees of inquiry into a pragma-dialectical argumentative approach, an analysis will be given of (...) the selected argumentative pattern. This analysis will reveal which standpoints are supported by which arguments and how these arguments relate to each other to increase the acceptability of the recommendation made. In addition, the analysis will explain the arguer’s argumentative choices in the pattern employed. (shrink)

In this paper, the author examines the use of pragmatic argumentation in European practices of political accountability in which the politicians explain and justify a future course of action which they plan to undertake in order to solve an existing problem. The author explains some vital institutional characteristics of the practices under discussion and demonstrates how these institutional characteristics constrain the use of pragmatic argumentation. In addition, the author shows which criteria arguers commonly invoke in practices of political accountability to (...) make their pragmatic arguments acceptable to critics. (shrink)

The European Union is making increased efforts to find simpler and more effective ways to function adequately in the eyes of its citizens by using ‘soft law’ instruments such as recommendations. Although they have no legally binding force, recommendations have practical and legal effects occurring partly due to their normative content in which a course of action is prescribed and further supported by arguments intended to persuade the addressees of a political position. Although recommendations function as persuasive instruments due to (...) their argumentation, the characteristics of argumentation and how it is employed to convince the addressee to comply with certain measures have not been investigated at all. The main goal of the paper is to explain how arguments are used by the European Commission when recommending Member States to follow a new course of action. First, we will unravel the justificatory reasons employed by the Commission in order to make Member States comply with new measures and we will show how these reasons are combined into an argumentative pattern : 1–23, 2016; J Argum Context 6: 3–26, 2017). This pattern basically prescribes a course of action to Member States, which is further supported by arguments in which the necessity and advantages of following the proposed course of action are justified. Second, we will explain how and why the way in which the arguments are combined in this complex pattern could be potentially persuasive for the Member States despite the legally non-binding character of recommendations. We will show that the European Commission tries to persuade the Member States to take new measures by evading the burden of proof imposed by the legislative framework. At a more specific level of analysis, we will delve into the implicit premises in the argumentation, which enable us to identify cases of evasion of the burden of proof due to the Commission’s use of implicit starting points which might not be accepted by the Member States. Corina Färber entwickelt eine integrierte Subjektivierungsanalytik im Anschluss an Louis Althusser, Michel Foucault und Judith Butler. Dies erlaubt ihr, die Subjektwerdung als ambivalenten und konkreten Prozess analysierbar zu machen und im Hinblick auf die Möglichkeiten der politischen Handlungsfähigkeit und politischen Subjektivierung zu befragen.

In this paper, the author examines the burden of proof in the argu- mentative confrontations taking part in practices of political accountability. She does so by explaining how politicians maneuver strategically with the burden of proof in an attempt at winning the discussion in which they are involved. After making clear the role of the burden of proof in defining the difference of opinion in argumentative confrontations, the author outlines the constraints imposed by practices of political accountability on the burden (...) of proof. Prior researches have highlighted challenges and variations arising from the requirements of research ethics committees and ethics governance systems across diverse research fields. This emphasizes the need to investigate how universities convey and implement research ethical practices. Research ethics plays a pivotal role in guiding the integration of ethical principles throughout all stages of research starting from its inception and planning to its completion and the dissemination of results. These practices encompass a range of considerations, reviews, guidelines, and processes aimed (...) at safeguarding the rights, dignity, health, safety, and privacy of research participants. Using the content analysis technique, this paper aims to analyse research ethical practices information on universities’ websites from three developed countries and developing countries respectively using the isomorphism conception. The findings suggest that the coercive, normative, and mimetic isomorphic pressures explain the research ethics governance practices. The ethical practices information was disclosed more on university websites of the developed countries. Suggestions to improve the university’s research ethics governance system for the post-COVID-19 era were provided in the paper. (shrink)

Intimate partners are an important source of support when pursuing health goals. A vast amount of literature documents the role of social support in alleviating recipients’ distress and facilitating health behaviors. Less studied is the phenomenon that providing support may entail a benefit for the provider, particularly in the context of health behavior change. In the present study, we investigated whether providing social support in daily life would be associated with more health behavior, and emotional and relational well-being that same (...) day, using a sample of romantic couples aiming to become more physically active. Ninety-nine inactive and overweight heterosexual romantic couples (=198 individuals) participated in this dyadic daily diary study. Both partners reported on the provision of social support, positive and negative affect, and relationship satisfaction in electronic end-of-day diaries across 14 consecutive days. Moderate-to-vigorous physical activity (MVPA) was objectively assessed via triaxial accelerometers (Actigraph GT3X+). Using the Actor-Partner Interdependence Model (APIM), dyadic data analyses indicated that providing support to the partner was associated with higher own MVPA, more own positive affect, less own negative affect, and more own relationship satisfaction (actor effects), over and above the effect of support provision on outcomes in the other partner (partner effects). The present findings suggest that the provision of daily social support in couples is strongly associated with enhanced well-being not only at a personal level but also at a relational level. Providing social support may also serve the function of relationship maintenance. Thus, shifting the focus away from the recipient to examine beneficial effects of social support in providers is highly relevant. Future research should address the question of when, why, and how giving support is beneficial. (shrink)

The use of numerical arguments has become part and parcel of evidence-based policymaking, serving increasingly as scientific evidence which is used to back up policy decisions and to convince citizens of the acceptability of those decisions. But numerical arguments and their quality and potential persuasive role in the specific institutional context of policymaking have received little treatment within argumentation theory. This paper endeavours to explain the forms, functions, and quality of numerical arguments in policymaking.

In this article, we offer a systematic description of intermedia relations across music, literature, the visual arts, and film. Beginning with some general reflections on materiality and medium in these diverse fields of art, we then offer various examples consisting of two media (e.g. music film, song, images in writing). We pursue the question if, and how, one of the two media may take priority over the other. In our conclusion, we deal with „intermedia relations in monomediality“. This section focuses (...) on artistic representations made in one medium, but based on reflections on another medium. For instance, this is the case when a novelist writes about a picture without having this picture reprinted in the text. (shrink)

El artículo rastrea en dos de los textos importantes de la obra de Niccolò Machiavelli : El Príncipe y los Discursos sobre la Primera Década de Tito Livio, elementos conceptuales inherentes a la noción psicoanalítica psicología de las masas. En el pensamiento del florentino es dable hallar cierta teoría psicológica, la cual es concebida como expresión de deseos y afectos humanos, a la cual el autor arriba a partir de una aguda observación empírica y del conocimiento del pasado. Machiavelli analiza (...) la ciudad como un campo de deseos en pugna, el deseo del pueblo de no ser oprimido y el de los nobles de ambición ilimitada. En el análisis que despliega el autor sobre estos deseos en conflicto, pero sobre todo en la relación entre el príncipe, los nobles y el pueblo, así como en la caracterización que realiza de éste, es posible hallar elementos en ciernes de la psicología de las masas desarrollos luego por el psicoanálisis freudiano. Patients who have an oncological disease and are in palliative care belong to a group that is often characterized as highly vulnerable, and their participation in clinical trials poses a number of ethical problems. This study is cross-sectional and analytic. In all, 82% of those who took part consider it ethical to conduct research with patients in palliative care, either to help other patients in the future, in the hope of gaining some improvement or due to confidence in the physician-researcher. (...) The wide acceptance to participate in these research studies shows the potential benefits appear to exceed the merely therapeutic ones. Altruism, hoping to improve or the perception of continuing to "fight" the disease are aspects to bear in mind when evaluating respect for the autonomy of the persons involved. (shrink)

This paper analyses the relationship between religion and the field of medicine and health care in light of other recent studies. Generally, religion and spirituality have a positive impact on disease. For patients diagnosed with malignancies and chronic diseases, religion is an important dimension of healing. From ancient times, God has been considered an inspiration for the physician's knowledge and healing resources. Some authors have proposed a brief history of spiritual and religious states that the doctor can apply to his (...) patient. Religiosity and spirituality allow patients to receive better social support and to benefit greatly from resources provided by religious organizations (cultural activities, jobs, and health care counseling). The two terms "religion" and "spirituality" have different meanings but are always in connection. Many studies emphasize that people with greater religiosity and spirituality have a lower prevalence of depression and suicide, better quality of life, and greater survival. Additionally the article discusses the complementary health care benefits of religious fasting. Caloric and protein restrictions promoted by religious fasting were associated with improvement in control or prophylaxis of many diseases and with longevity. (shrink)
